The privacy statement explains why and what personal data we request and process, as well as the purpose for which we use it. By using our websites and/or our services/products offered by ourselves or by our partner, you accept that certain personal data are automatically collected in the databases of DE RYCKE BVBA or its partners and processed in accordance with the purposes described below.
The aforementioned data files are the exclusive property of DE RYCKE BVBA or its partners and are only accessible to persons who must have access to them according to their duties. DE RYCKE BVBA and its partner companies DR-TRANS BVBA and IMMO MANAGEMENT DE RYCKE BVBA can consult and use information from each other’s databases as described below.

2. Processing of personal data.
DE RYCKE BVBA and its partners collect and process personal data in different ways from parties with whom they are in contact such as customers, prospective customers, suppliers, third parties, …
It concerns the following personal data collected as soon as you contact DE RYCKE BVBA or its partners by telephone, e-mail, visit to our offices, mail, use of our website:
– Contact and administrative data of a legal entity: company name, trade name, registered office address, billing address, delivery address, CBE number, e-mail address, telephone number(s), contact persons, positions of employees, bank account numbers, IP addresses and/or domain name when visiting our website, VAT number, financial data, …;
– Contact and administrative data of a natural person: surname and first name, trade name if any, address of residence or exercise of professional activity, billing address, delivery address, CBE number, e-mail address, telephone number(s), contact person, bank account numbers, IP addresses and/or domain name when visiting our website, VAT number, financial data, …;
– Camera footage when visiting one of our facilities;
– Recording of telephone conversations when contacting our company by phone;
– We collect this data when you fill out our documents and forms manually and also when you do so electronically; when you visit our website, if any files and other technologies (such as cookies) are used;
– Location determination of rented equipment/machines via track and trace systems.
We will also (have to) process your data if you contact us in any other way. Finally, it is also possible that we obtain data about you through third parties and the partner companies and use this data to contact you with a view to concluding a contract.
This data is processed to correctly process your inquiry or order, to identify you and to contact you. Also, this information is used to build a contact record and see who uses our services.
3. The reasons why we collect your personal data
We use the personal data we collect for a variety of purposes. We leave you below with an overview of the purposes for which they are used.
3.1 For contacts at customers or prospects:
3.1.1 Contracting:
Your information is necessary to properly execute the agreement you enter into with us. Because you enter into a contract with us, we need to have the personal data necessary to provide our services contained in the contract. Your information is also needed to identify and contact you regarding your quote request or order.
Personal data collected are processed administratively and for accounting purposes. If you do not want your personal data to be processed in this context, it is not possible to perform the services for which you are contractually bound to us.
3.1.2 Delivery of the ordered/leased goods or services or performance of the order or rental contract:
We use your contact information to handle your order or rental agreement. This includes the delivery of the goods and services to the location you specify, as well as the retrieval of the goods.
In this sense, we also reserve the right to pass on your information to so-called third parties, partner companies or subcontractors who cooperate with us in the framework of the transferred request for quotation or in the framework of the handling of the ordered/hired goods or services.
3.1.3 Request for information:
If you have any questions regarding any of our products or services you can visit our website or you can ask your question by e-mail. Your personal information as well as e-mail address and other contact information you provide will be kept only as long as necessary to fully answer the question. After all, we want to help you the best we can.
We may use this information made available to us as evidence to prove that we have informed you correctly, but are not obliged to do so.
3.1.4 Telephone:
We are here to help you realize your project. If you have any questions prior to or while performing our services, please contact us by phone. All incoming calls are visible on phone screens and a call log of received and missed calls is maintained. This way we can always contact you back if needed.
If you have telephone contacts with us, these telephone conversations may be recorded for the purpose of providing evidence regarding the services ordered/delivered or regarding the settlement of the rental agreement or in the context of providing evidence in the event of damages or legal disputes.
3.1.5 Direct Marketing:
We may use your personal information to send you marketing offers, information surveys and invitations via emails, text messages, telephone way, the mail or via social media. Based on previously ordered goods and services, website visit and information you have submitted to us, we will provide you with relevant information, recommend products and send you personalized offers.
3.1.6 Camera images:
At our facilities, and this both inside and outside, we use camera recordings for loss prevention management by ensuring compliance with the terms and conditions and to detect and prevent misuse of our services.
We also use images for video surveillance, for security reasons to track damages and incidents, and to prevent and report crimes at our facilities. Incidents and fraud may be shared with insurance companies and insurance intermediaries, attorneys, legal authorities or local and international law enforcement agencies to complete investigations. Keep in mind that many of these recipients will have an independent right or obligation to process your personal data.
3.1.7 Track & trace:
The equipment and machinery in your possession under a use or rental agreement may be equipped with a track and trace system. This enables us to determine the exact location of our devices / machines at all times, as well as to verify at what time and for how long you use them.
The data from the track and trace system can be used to retrieve the aforementioned machines, as well as to verify when a lease has effectively ended. The data from the track and trace system can also be used as evidence in legal proceedings or amicable settlements.
3.2 For potential new contacts and prospects:
If you have somehow handed us a business card, we will include you in our database. We assume that by handing over, you are also giving your express permission to be included in our database.
As far as mere prospects are concerned, these are natural and legal persons who are not (yet) customers of ours, we process the data for purposes of direct marketing, based on our legitimate interest in doing business. To prospects who are contacted by e-mail, we ask for their express permission to continue to contact them in the future. Prospects who are approached by letter are requested to tick an opt-out clause if they do not wish to be contacted further by us.
In addition, we also store publicly available data we find about you in our database. We assume that we may also retain this personal data since you have made it publicly available.
3.3 For suppliers:
Personal data necessary for the performance of the contract are collected. These are mainly e-mail addresses and contact phone numbers to allow easy communication.
We process this data as part of our supplier management and on the basis of the contractual relationship we have or establish with our suppliers.
3.4 For employees and applicants:
To our employees and applicants we process the data for purposes such as personnel management and payroll administration; possible recruitment; training and evaluation of staff members; compliance with social, tax and other obligations; dissemination of publications and internal communications; security and risk prevention, fraud prevention; cost accounting, possible recommendations regarding other employers, e-mail traffic.
Article 3.1.6. also applies to employees.
4. Who has access to your personal information?
In principle, your personal data is not passed on to other parties, with the exception of the aforementioned partner companies who, as stipulated above, exchange data among themselves.
DE RYCKE BVBA and its partners process personal data in accordance with the purposes mentioned under point 3. Only employees within our organization, who in the performance of their duties need your personal data, will be able to consult it. Branches belonging to our corporate group are not considered third parties insofar as they process the data on behalf of DE RYCKE BVBA.
DE RYCKE BVBA and its partners will only communicate the personal data provided and collected to third parties if you give us your express prior consent or if this is necessary for the execution of our services.
In certain cases we have a legal obligation to retain and/or disclose certain personal information about you to government agencies and/or judicial authorities e.g. social secretariat, tax obligations or in the context of a police or judicial investigation.
It is possible that we may transfer data to companies with whom we cooperate, so-called “third parties.
DE RYCKE BVBA can make use of subcontractors, so-called ‘third parties’, in order to outsource some of its services to them, such as ICT companies that take care of the maintenance and management of the websites/telephone exchange/internal registration systems, credit control companies, insurance companies and intermediaries, legal assistance, social secretariat, marketing agencies, transport companies, subcontractors who carry out all or part of the contractually agreed services,… These third parties help us for the proper handling of the agreed performance. We ensure that these subcontractors manage your data with due diligence and process it in accordance with the law of December 8, 1992 on the protection of privacy and the General Data Protection Regulation of April 27, 2016.
5. Retention period of your data?
We process your personal data for a period necessary in function of the purposes of the processing as described in point 3. We keep your data for as long as you are an active customer. In addition, we retain your personal data in accordance with any legally required time limits and any statute of limitations that may apply. For example, for invoices, this is 7 years.
We retain camera images, recorded telephone calls and track and trace system data for the time we need to prevent and/or report possible fraud and other violations. Camera images, recorded telephone calls and track and trace system data are kept in accordance with local laws.
6. How do we secure your personal data?
We secure all data you transmit to us within the state of the art with all necessary technical, legal and organizational measures to avoid the destruction, loss, falsification, modification, access by unauthorized persons or inadvertent notification to third parties of collected personal data as well as any other unauthorized processing of this data.
To this end, DE RYCKE BVBA and partners use firewalls, antivirus systems, encryption of data and internal password protection. Within our organization, data are accessible only to responsible persons who must have access to them according to their duties. All employees are reminded that they must always and permanently treat information obtained as part of their job as strictly confidential. They follow a set of clear guidelines for this purpose and are trained and made aware of their responsibilities on a regular basis. If it is necessary for us to transfer your data to other companies (read point 4 why), we require that this company treat the data as carefully as we do. Also, that company may only use the data for the purpose for which that company obtained it.

7. Cookies
We want to make sure you can use our website in the best and most personal way possible. To do this, we use functional, analytical and tracking cookies. A cookie is a small text file that is stored in the browser of your computer, tablet or smartphone when you first visit this website. DE RYCKE BVBA and partners use cookies with a purely technical functionality. These ensure that the website works properly and that, for example, your preferences are remembered. These cookies are also used to make the website work properly and to optimize it.
8. What are your rights?
The personal information we collect about you through various channels is included in the files of DE RYCKE BVBA and partners. You have the following rights to ensure the protection of your personal data.
8.1 Right of access
If you would like to see what personal data we process about you, you can do so by exercising your right to view. DE RYCKE BVBA and partners will give you as complete an overview as possible of the personal data held about you. We can already confirm that no special categories of personal data are kept (such as race, ethnicity, health data, data concerning sexual orientation, etc.). You can get a copy of the personal data collected by e-mail.
8.2 Right of correction
If there are any changes in your personal data (such as name, address, e-mail address,…), you can always have it corrected or completed.
8.3 Right to erasure
If you believe that we are processing certain personal data on an unlawful basis, i.e. without a proper purpose for doing so, you may request that your personal data be deleted, except in the following situations:
8.4 Right to limitation
If your data is incorrect and you have asked for it to be amended or you believe that we are processing your personal data on an unlawful basis, you may request that we restrict its processing. This means that we may further process your personal data only with your consent. We may continue to store your personal data, but may not carry out any further processing with it without your consent, except in the context of legal proceedings, for the protection of natural or legal persons or for important reasons of public interest.
8.5 Right to data transfer
You may request that your personal data be transferred directly to a third party. If you wish, you may ask us to transfer to you or directly to a third party the data you have provided to us yourself. This in a structured, commonly used and machine-readable format
format. This applies only to the personal information you have submitted to us. The Regulation does provide some restrictions on this right, so it does not apply in all cases. This, of course, must be examined on a case-by-case basis.
8.6 Right to withdraw consent.
Where your personal data is processed on the basis of consent, you may withdraw this consent at any time. We will then have to delete your personal data.
8.7. How can you exercise your rights?

We are therefore happy to help you if you have a complaint about our processing of personal data.
